1. About these Terms

These Terms & Conditions (“Terms”) govern all sales made through dialcrown.eu (“the Website”) by MW Consulting, trading as Dial & Crown (“we”, “us”, “our”, “Seller”).

By placing an order on our Website, you confirm that you have read, understood, and agreed to these Terms.

These Terms apply to all customers — both consumers (private individuals) and business customers (entrepreneurs purchasing in connection with their business activity). Where consumer protections under EU and Polish law apply, they take precedence over any provision of these Terms that would limit them.

3. Definitions

  • Buyer / Customer — any person placing an order through the Website
  • Consumer — a natural person purchasing for purposes outside their trade, business, or profession (in accordance with Article 22¹ of the Polish Civil Code and Article 2(1) of Directive 2011/83/EU)
  • Entrepreneur — a person purchasing in connection with their business activity
  • Watch / Product — any timepiece offered for sale through the Website
  • Order — the Buyer’s offer to purchase a Watch on the terms presented
  • Sales Contract — the agreement formed between the Buyer and the Seller upon order acceptance

4. Products and pricing

4.1 Nature of products

All watches sold by Dial & Crown are second-hand vintage timepieces. As mechanical objects with decades of history, each watch carries individual characteristics — patina, micro-scratches, dial aging, and other signs of authentic use. These features are part of the watch’s identity and are not considered defects.

Each watch is described in detail on its product page, including:

  • Reference and serial number (where available)
  • Approximate year of manufacture
  • Condition of case, dial, hands, crown, and movement
  • Service history (if known)
  • Originality of components
  • Photographic documentation
  • Any known flaws or notable wear

We do our utmost to describe each watch accurately. The product description forms part of the Sales Contract.

4.2 Pricing and VAT

All prices on the Website are displayed in EUR and are inclusive of VAT.

Dial & Crown applies the margin scheme for second-hand goods (procedura VAT marża) under Article 120 of the Polish VAT Act (Ustawa o podatku od towarów i usług) and Article 313 of EU Directive 2006/112/EC.

Under this scheme:

  • VAT is calculated on the margin (difference between purchase and sale price), not on the full sale price
  • Buyers cannot deduct input VAT from the purchase, as no separate VAT amount is itemised on the invoice
  • Invoices are issued as “Faktura VAT marża” with the annotation “procedura marży — towary używane”

Prices remain valid as displayed at the moment of order placement. We reserve the right to change prices for unsold watches at any time.

4.3 Availability

Each watch we offer is unique. Availability is updated in real time on the Website. Once a watch is sold, it is removed from the active collection and may appear in our archive.


5. Order process and contract formation

5.1 Placing an order

To place an order, you:

  1. Select a watch from the Collection
  2. Add it to your cart
  3. Proceed to checkout, providing accurate billing and delivery details
  4. Choose a payment method
  5. Review your order and confirm the purchase

5.2 Order confirmation

After placing an order, you will receive an automatic confirmation email containing the order details. This automatic email confirms receipt of your order, not acceptance of the contract.

The Sales Contract is formed when we send a separate order acceptance email confirming dispatch readiness. We reserve the right to refuse any order at our discretion, particularly in cases of:

  • Suspected fraud or unauthorised payment
  • Inability to verify the Buyer’s identity
  • Pricing errors or technical malfunctions
  • Stock unavailability (e.g. simultaneous purchase by another customer)

In the event of order refusal, any payment received will be refunded in full within 14 days.

5.3 Pre-purchase consultation

For high-value or specific watches, we may invite you to a video call or extended email exchange before completing the sale. This is to ensure clarity on condition, expectations, and suitability — and to maintain the standards of personal service we aim for.


6. Payment

We accept the following payment methods:

  • Credit and debit cards (Visa, Mastercard) via Mollie
  • PayPal
  • SEPA bank transfer (EU customers)
  • Other methods as displayed at checkout

Payment is processed at the time of order placement. Watches are dispatched only after full payment has been received and cleared.

We do not store credit card information. All payment data is handled securely by our payment processors (Mollie B.V., PayPal Europe S.à r.l.) in compliance with PCI-DSS standards.


7. Shipping and delivery

7.1 Coverage

We currently ship within the European Union only.

7.2 Carrier and insurance

All watches are dispatched via DHL Express, with full insurance for the value of the watch in transit. A signature is required on delivery.

7.3 Timeframes

  • Dispatch: within 2 business days of payment clearance
  • Transit: typically 1–3 business days within the EU

These are estimates; we cannot guarantee specific delivery dates due to factors outside our control (customs, weather, carrier delays).

7.4 Costs

Shipping costs are calculated at checkout based on destination, according to DHL Express rates, and include insurance.

7.5 Risk transfer

For consumers, risk passes to the Buyer upon physical delivery (Article 548 of the Polish Civil Code, in line with EU Directive 2011/83/EU).

For entrepreneurs, risk passes upon handover to the carrier.

7.6 Customs and duties

All EU shipments are duty-paid. No additional customs charges apply within the European Union.


8. Right of withdrawal (consumers only)

8.1 Statutory right

If you are a consumer, you have the right to withdraw from the Sales Contract within 14 days of receiving the watch, without giving any reason, in accordance with EU Directive 2011/83/EU and the Polish Act on Consumer Rights of 30 May 2014.

8.2 How to exercise the right

To withdraw, you must notify us within 14 days of delivery by:

  • Sending an unambiguous written statement to michael@dialcrown.eu, or
  • Using the model withdrawal form (available on our Shipping & Returns page or sent on request), or
  • Sending a written statement to our registered address

8.3 Returning the watch

After notifying us, you must return the watch within 14 days, in unused condition, with all original packaging, documentation, and accessories.

  • Return shipping and insurance costs are borne by the Buyer
  • We strongly recommend using DHL Express with insurance equivalent to the watch’s value
  • The watch remains your responsibility until it arrives at our address

8.4 Refund

We will refund the full purchase price (including original delivery costs, up to the cost of standard delivery) within 14 days of receiving the returned watch and confirming its condition.

Refunds are issued to the original payment method.

8.5 Reduction of refund

We reserve the right to reduce the refund amount if the returned watch shows signs of use beyond what is necessary to assess its nature and characteristics. Such signs include (but are not limited to):

  • Wrist marks or wear on the strap
  • Scratches not present at the time of dispatch
  • Adjustments or modifications carried out by the Buyer or third parties
  • Missing or damaged packaging, documentation, or accessories

In severe cases, the watch may be deemed used and the right of withdrawal may not apply.

8.6 Exclusions

The right of withdrawal does not apply in the following cases:

  • Watches modified, customised, or serviced at the Buyer’s specific request
  • Sales between business entities (B2B), unless explicitly agreed otherwise

9. Warranty

9.1 Dial & Crown warranty

Every watch sold by Dial & Crown comes with a 12-month warranty on the movement, beginning on the date of delivery. This warranty is offered voluntarily, in addition to your statutory rights as a consumer.

9.2 What the warranty covers

  • Mechanical faults in the movement arising from normal use
  • Manufacturing defects that become apparent within the warranty period

9.3 What the warranty does not cover

  • Crystal, crown, pushers, gaskets, bracelets, straps, and buckles
  • Water damage of any kind — vintage watches are not water-resistant regardless of original specifications
  • Damage from impact, drops, magnetism, or exposure to extreme temperatures
  • Normal wear of the case, dial, hands, or finishing
  • Issues resulting from servicing, adjustment, or modification carried out by third parties without our prior written consent
  • Battery replacement in quartz movements

9.4 Claiming under warranty

To make a warranty claim:

  1. Contact us at michael@dialcrown.eu with a description of the issue and photographs if relevant
  2. We will assess the claim and, if covered, arrange the return of the watch to our service partner at our cost
  3. Warranty repairs are completed free of charge
  4. Repair turnaround time is typically 4–8 weeks, depending on parts availability

9.5 Statutory rights of consumers

Independently of our voluntary warranty, you retain all rights under Polish and EU consumer law.

In particular, under the Polish Act on Consumer Rights and EU Directive 2019/771 on the sale of goods:

  • We are liable for any lack of conformity of the watch with the Sales Contract that exists at the time of delivery and becomes apparent within 12 months of delivery (the statutory period for second-hand goods, as permitted under Article 7(1) of the Directive)
  • A “lack of conformity” means the watch does not match the agreed description, is not fit for its usual purpose, or does not have the qualities the Buyer could reasonably expect
  • Within the first 12 months, the burden of proof regarding non-conformity rests with us
  • Remedies include repair, replacement, price reduction, or contract termination, in the order and manner provided by law

9.6 B2B sales

For sales to entrepreneurs (business customers), statutory warranty under the Polish Civil Code (rękojmia) is excluded, in accordance with Article 558 § 1 of the Polish Civil Code. Only the voluntary 12-month movement warranty applies.


10. Authenticity and originality

10.1 Our commitment

Every watch sold by Dial & Crown has been authenticated by experienced specialists and inspected component by component. We stand behind the authenticity of each piece.

10.2 If a watch is found inauthentic

In the unlikely event that a watch is later proven to be inauthentic (e.g. counterfeit, with a fake dial or movement) by an independent expert recognised in the watchmaking industry, we will provide a full refund including return shipping costs, with no time limit on the claim.

10.3 Originality of components

Where components are not original to the watch (e.g. service replacement parts, redial, replaced hands), this is disclosed clearly in the product description. The Buyer accepts the watch with these disclosed characteristics as part of the Sales Contract.


11. Liability

11.1 Our liability to consumers

Nothing in these Terms limits or excludes our liability where it cannot be limited or excluded under applicable law. In particular:

  • Our liability for death or personal injury caused by our negligence
  • Liability for fraud or fraudulent misrepresentation
  • Liability under statutory consumer warranty (rękojmia / lack of conformity)
  • Any other liability that cannot be excluded under Polish or EU law

11.2 Our liability to entrepreneurs

For business customers, our total liability under any Sales Contract is limited to the purchase price of the watch. We are not liable for indirect or consequential losses, including loss of profit, business opportunity, or data.

11.3 Force majeure

We are not liable for delays or failures in performance caused by events outside our reasonable control, including natural disasters, strikes, transportation disruptions, governmental actions, or pandemics.


12. Complaints and dispute resolution

12.1 Internal complaint procedure

We aim to resolve all issues amicably and quickly. To file a complaint:

  • Email us at michael@dialcrown.eu with details of the issue
  • Include order number, photographs, and description
  • We will respond within 14 days

12.2 Out-of-court dispute resolution

If we cannot resolve a dispute directly, consumers within the EU may use the European Commission’s Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr.

Polish consumers may also use:

  • Provincial Inspectorate of Trade Inspection (Wojewódzki Inspektorat Inspekcji Handlowej)
  • Permanent Consumer Arbitration Court (Stały Polubowny Sąd Konsumencki)
  • Municipal Consumer Ombudsman (Miejski Rzecznik Konsumentów)

Use of these mechanisms is voluntary; we are not obligated to participate.

12.3 Court jurisdiction

Subject to mandatory consumer protection rules:

  • Disputes with consumers may be brought before the courts competent under Polish and EU law (typically the consumer’s place of residence or our registered office)
  • Disputes with entrepreneurs are subject to the exclusive jurisdiction of the court competent for our registered office in Warsaw, Poland

13. Intellectual property

All content on the Website — including text, photographs, logos, and design — is the property of Dial & Crown or used under licence. Reproduction, redistribution, or commercial use without prior written consent is prohibited.

Watch brand names (Omega, Rolex, etc.) are the property of their respective holders and are used only for descriptive purposes.


14. Personal data

Personal data is processed in accordance with our Privacy Policy.


15. Changes to these Terms

We may update these Terms from time to time. The version applicable to your purchase is the one in effect at the moment of order placement. Material changes will be communicated via email or a notice on the Website.


16. Governing law

These Terms are governed by Polish law, with mandatory consumer protections under EU law fully respected.
